CLARKE, Magistrate Judge. This is an action b r o u g h t by a pro se plaintiff. Defendants have filed a motion f o r summary j u d g m e n t seeking t o dismiss p l a i n t i f f s case. I f defendants' motion is granted, i t will result in dismissal o f some or all o f plaintiffs' claims against defendants. Although i t is n o t required, t h e Court is issuing this o r d e r t o i n f o r m p l a i n t i f f o f t h e requirements o f Federal Rule o f Civil Procedure Rule 56 and Local Rule 56, which govern motions f o r summary j u d g m e n t . Motions f o r s u m m a r y j u d g m e n t are governed by Federal Rules o f Civil Procedure 56. A p a r t y is entitled t o s u m m a r y j u d g m e n t where t h e d o c u m e n t a r y evidence produced by t h e parties permits only one conclusion. Anderson v. Liberty Lobby, I n c . , 477 U.s. 242, 251-52 (1986). A party seeking summary judgment bears the initial responsibility o f informing the Court o f the basis o f its motion, and identifying those portions o f the pleadings, depositions, answers t o interrogatories, and admissions on file, together w i t h affidaVits, i f any, and other evidence which i t believes demonstrate the absence o f a genuine issue o f material fact. Celotex Corp. v. Catrett, 477 U.s. 317, 325 (1986). I f the moving party meets its initial burden o f showing the absence o f a material and triable issue o f fact, t h e burden then moves t o the opposing party, who must present significant probative evidence tending t o support its claim o r defense. I n t e l Corp. v. Hartford Accident & Indem. Co., 952 F.2d 1551, 1558 (9th Cir. 1991). The nonmoving party must do more than simply show t h a t there is some metaphysical doubt as t o the material facts. Matsushita Elec. Indus. Co. v. Zenith Radio Corp., 475 U.S. 574, 586 (1986). The nonmoving party must come forward with sufficient evidence demonstrating to the Court t h a t there are genuine issues o f material fact t o be decided a t trial. Fed. R. Civ. P. 56(e). The nonmoving party may not simply rely upon the pleadings t o designate specific facts establishing a genuine issue for trial. I d . ; see also Celotex Corp., 477 U.s. at 324. The existence o f a genuine issue o f material fact may be demonstrated through the use o f affidavits and discovery materials such as depositions, answers t o interrogatories, admissions, or other admissible evidence. Celotex Corp., 477 U.s. a t 324; see also Fed. R. Civ. P. 56(c) & (e). "Rule 56(e) requires t h a t the adverse party's 'response,' n o t j u s t the adverse party's various o t h e r papers, ' s e t f o r t h specific facts' e s t a b l i s h i n g a g e n u i n e issue." Carmen v. San Order - 2 Francisco Unified Sch. Dist., 237 F.3d 1026, 1031 (9 th Cir. 2001). I f the nonmoving party fails t o respond with evidence t h a t contradicts the moving party's evidence creating a genuine issue o f material fact, the court will take the facts set forth by the moving party as true, and this failure could result in t h e e n t r y o f summary j u d g m e n t against the nonmoving p a r t y and dismissal o f the nonmoving party's claims. See Davis v. Zahradnick, 600 F.2d 458, 460 (4th Cir. 1979). I f the record taken as a whole could not lead a rational t r i e r o f fact t o find f o r the nonmoving party, there is no genuine issue for trial, and summary j u d g m e n t will be entered in favor o f the moving party. Matsushita, 475 U.S. a t 587 (citing First Nat'l Bank o f Ariz. v. Cities Servo Co., 391 U.s. 253, 289 (1968)). The granting o f a motion f o r summary j u d g m e n t could result in the dismissal o f the case w i t h o u t a full trial. Rand v. Rowland, 154 F.3d 952 (9th Cir. 1998). Furthermore, summary j u d g m e n t motions are governed by Local Rule 56. 1 Pursuant t o t h a t rule, opposition t o a motion f o r summary j u d g m e n t must be accompanied by a separate concise statement t h a t ( 1 ) accepts or denies each fact set forth in the defendants' concise statement; o r (2) specifically opposes defendants' contention o r interpretation o f an alleged undisputed material fact; a n d / o r (3) articulates other relevant material facts omitted by defendants and necessary to determination o f the motion f o r summary judgment. Local Rule A copy o f Local Rule 56 is enclosed with this Order. The Local Rules, in addition to o t h e r i m p o r t a n t information, may also be viewed on t h e Court's website at: www.ord.uscourts.gov. The Court's Local Rules can be accessed by selecting the link "Local Rules o f Practice and Procedure," and the Federal Rules o f Civil Procedure can be accessed by f i r s t selecting t h e link "Federal Judicial Resources," and then by selecting "Federal Rules o f Civil Procedure." 1 Order - 3 56(b). The separate concise statement should be set forth in numbered paragraphs as t o each fact, and should refer t o the specific portion o f the record where the fact is found. "A party must cite t o a particular affidavit, deposition, or other document (indicating both page and line number references where appropriate) supporting the party's statement, acceptance, or denial o f the material fact." Local Rule 5 6 . l ( c ) ( 1 ) . As a general rule, the concise statement o f facts should not exceed five pages. Local Rule 5 6 . l ( d ) . The court has no independent duty to search and consider any part o f the record not referenced in the parties' separate concise statement o f facts. Local Rule 5 6 . l ( e ) ; see Carmen, 237 F.3d a t 1028-31. Finally, upon failure to submit a separate concise statement o f material facts in opposition t o defendants' concise statement specifically denying or otherwise controverting defendants' concise statement, the material facts set forth in defendants' concise statement will be deemed admitted for purposes o f the motion for summary judgment. Local Rule 56.1(f). Plaintiff shall have until November 30, 2009, t o file a supplemental response t o defendant's motion in accordance with the requirements o f Federal Rules o f Civil Procedure 56 and Local Rule 56. 2 Thereafter, defendants shall file t h e i r reply t o p l a i n t i f f s response.
