U p o n c o n s i d e r a t i o n o f t h e U n i t e d S t a t e s ' c o m p l a i n t , m o t i o n for a t e m p o r a r y r e s t r a i n i n g order, and supporting materials: This court finds that plaintiff, United States o f America, has established that: it is likely to prevail on the merits o f its trespass and ejectment claims because Defendant is occupying and operating a mining operation o n public lands without lawful authority; irreparable harm to the environment has taken place and will continue to be suffered without a temporary restraining order; the balance o f equities is i n favor o f the United States and it is i n the public interest to t e m p o r a r i l y r e s t r a i n D e f e n d a n t from f u r t h e r o c c u p a n c y a n d m i n i n g w i t h o u t a n a p p r o v e d p l a n o f operation. T h e r e f o r e , IT IS HEREBY ORDERED that Defendant Clifford R. Tracy, shall not conduct m i n i n g o p e r a t i o n s a t t h e C e d a r G u l c h G r o u p p l a c e r m i n i n g c l a i m w i t h i n t h e R o g u e RiverSiskiyou N a t i o n a l Forest; a n d IT IS F U R T H E R ORDERED that the defendant, Clifford R. Tracy, shall not move or use any equipment, motor vehicles and personal property on the Rogue River-Siskiyou National Forest without written authority from the U.S. Forest Service. The court finds t h a t issuance o f this order without notice to the Defendant is necessary due to the remote location o f the Defendant and the land involved and that the United States attempted to provide personal oral notice to the Defendant b u t was unsuccessful.
