Plaintiff is advised that a complaint need not contain c i t a t i o n t o c a s e law. A c o m p l a i n t , a s s t a t e d i n Fed. R. C i v . P. 8 ( a ) a n d n o t e d i n t h e R & R, n e e d o n l y c o n t a i n a s h o r t a n d concise statement of the facts giving rise to plaintiff's claims. P l a i n t i f f ' s amended corrplaint, while c i t i n g ample case law, contains almost no s p e c i f i c factual allegations r e l a t i n g to t h i s p a r t i c u l a r defendant. P l a i n t i f f must, a t a minimum, enable the defendant and the court to determine what claims p l a i n t i f f r a i s e s . P l a i n t i f f ' s Memorandum of Points and A u t h o r i t i e s , A r g u m e n t o f t h e P l a i n t i f f , a n d C a s e Law s e c t i o n s , s i g n i f i c a n t l y add to the length of complaint's clarity. I t is clear that plaintiff hcs exercised substantial ingenuity in the preparation of this complaint. Rather than (apparently) cutting and pasting various legal arguments from various sources, p l a i n t i f f may well be b e t t e r o f f by simply a l l e g i n g how t h i s p a r t i c u l a r d e f e n d a n t h a r m e d h e r . F o r e x a m p l e , t~e complaint yet detract from the To t h e e x t e n t p l a i n t i f f ' s f i l i n g i s a S e c o n d A m e n d e d Complaint or Motion for Summary Judgment, i t i s not referenced i n the R & Rand - l i k e defendant's motion to dismiss [31J - i s not subject to this order. 2 - ORDER if p l a i n t i f f f e e l s d e f e n d a n t i s c o n d u c t i n g a w r o n g f u l foreclosure, plaintiff should simply say so. Is defendant harming p l a i n t i f f because defendant lacks the "note?" Did defendant violate the Fair Debt Collection Reporting Act? I f so, how? Succinct factual allegations, as opposed to numerous pages of legal citations relating to numerous different legal theories, may allow the defendant and the c o u r t t o determine the b a s i s of defendant's claims. Only after the defendant and court determine the basis of plaintiff's claims will the parties potentially proceed to the merits cf those claims. Following the factual a l l e g a t i o n s , p l a i n t i f f may wish t o s e p a r a t e l y s t a t e each particular claim to relief raised. CONCLUSION Magistrate Judge Clarke's R & R [#28] i s adopted. P l a i n t i f f i s granted 20 days t o f i l e an amended complaint.
