IT IS HEREBY ORDERED that Plaintiffs objections that were incorrectly docketed in Cv 09-687-PK be fi led in this case. Defendants' Motion to Dismiss (# 15 ) is granted. Plaintiff may file an amended complaint by December 2, 2009. If plaintiff has not filed an amended complaint by December 2, 2009, the case will be dismissed with prejudice. When either party objects to any portion o f a magistrate's Findings and Recommendation concerning a dispositive motion or prisoner petition, the district court must make a de novo determination o f that portion o f the magistrate's report. 28 U.S.C. § 6 3 6 ( b ) ( l ) ; Fed. This court has, therefore, given de novo review o f the rulings o f Magistrate Judge Papak.
