Opinion and Order. Defendant Clackamas County's Motion to Dismiss 5 and defendant State of Oregon's Motion to Dismiss 8 are granted in part. This matter is dismissed without prejudice. The State of Oregon is ordered to re-issue its declaratory ruling to provide plaintiffs with an opportunity to appeal that decision to the Oregon Tax Court, as noted herein.
