Before the Court is Transport Financial Services, LLC’s Motion to Restrain Defendants
from Instituting Any Proceedings Affecting the BMC-85 Trust Fund. Pursuant to 28 U.S.C.
OPINION & ORDER - 1
§ 2361, the Court hereby orders that Defendants be restrained from instituting or prosecuting any
proceeding in any State or United States court affecting the surety instrument at issue in this
case, Form BMC-85 Broker’s or Freight Forwarder’s Trust Fund Agreement, until further order
of the Court.
CONCLUSION
The Motion to Restrain Defendants from Instituting Any Proceedings Affecting the
BMC-85 Trust Fund is GRANTED.
