Pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. ยง 2412, it is hereby ordered that EAJA attorney's fees of $8,998.35 and $400.00 in costs shall be awarded to Plaintiff. If it is determined that Plaintiffs EAJA fees are not subject to any offset allowed under the Department of the Treasury's Offset Program, then the check for EAJA fees shall be made payable to Max Rae, based upon Plaintiffs assignment of these amounts to Plaintiffs attorney.
