NOTICE OF CROSS-APPEAL
Notice is hereby given that Plaintiffs David Rudovsky and Leonard Sosnov hereby crossappeal to the United States Court of Appeals for the Third Circuit from the final judgment
entered in this action on April 13, 2011, insofar as the judgment reduced the jury’s punitive
damages awards from $2.5 million to $110,000 per plaintiff, and from all prior interlocutory
orders and rulings that produced and are merged into the final judgment, including this Court’s
Order of April 13, 2011, insofar as that Order denied plaintiffs’ Motion for Reconsideration of
the Portion of the Court’s March 30, 2011 Order Conditioning the Denial of Defendants’ Motion
for a New Trial on Plaintiffs’ Acceptance of a Reduced Amount of Punitive Damages, and this
Court’s Order of March 30, 2011, insofar as that Order conditioned the denial of Defendants’
Motion for a New Trial on plaintiff’s acceptance of a reduced amount of punitive damages.
