hereby ORDERED that Defendants’ Motion is GRANTED in part and DENIED in part.
Counts I, II, III, IV, VI, and VIII are DISMISSED. Count VII is DISMISSED to the extent that
it asserts a claim under N.Y. Gen. Bus. Law § 350.
