Steven Akpunonu and County of Delaware’s Motion to Dismiss (Doc. No. 23) and Plaintiff’s
response in opposition (Doc. No. 26) and Defendant Donald Havens’ Motion to Dismiss (Doc.
No. 24) and Plaintiff’s response in opposition (Doc. No. 25), and for the reasons set forth in the
accompanying Memorandum, IT IS HEREBY ORDERED as follows:
(1)
The Motion to Dismiss (Doc. No. 23) is GRANTED as to the claims against
Defendant Akpunonu in his individual capacity and DENIED as to the Monell
claim (Count I) and the ADA and RA claim (Count II) against the County.
(2)
Defendant Havens’ Motion to Dismiss (Doc. No. 24) is GRANTED.
