AND NOW, this 4th day of April 2017, upon consideration of Defendant’s Motion for
Summary Judgment on Counts II-IV [Doc. No. 28], to which no response has been filed, and for
the reasons set forth in the accompanying Memorandum Opinion, it is hereby ORDERED that
the Motion is GRANTED.
The parties shall notify the Court in writing no later than April 18, 2017 whether they
wish to have a settlement conference before a magistrate judge, or, in the alternative, to propose
dates for trial.
