Defendant’s Response thereto and Plaintiff’s Reply, as well as the record therein, and
after review of the Report and Recommendation of United States Magistrate Linda K.
Caracappa, Plaintiff’s objections thereto and Defendant’s response, it is hereby
ORDERED as follows:
1. The Report and Recommendation is not adopted;
2. Plaintiff’s Request for Review of the decision of the Commissioner of the
Social Security Administration is GRANTED; and
3. This matter is REMANDED to the Commissioner, pursuant to sentence four
of 42 U.S.C. § 405(g), for further proceedings consistent with the court’s
accompanying memorandum.
