ORDERED that, for the reasons set forth in the accompanying Memorandum Opinion, the motion
for summary judgment is GRANTED.

Accordingly, JUDGMENT is entered in favor of

Defendant Dr. Ronald Burkholder and against Plaintiff Paul Shifflett.
