The amended complaint (Doc. No. 10) is DISMISSED WITHOUT
PREJUDICE for lack of subject-matter jurisdiction; 1
The plaintiff’s request for appointment of counsel (Doc. No. 6) is DENIED; and
The clerk of court shall mark this matter as CLOSED.
