IT IS FURTHER ORDERED that Count I of plaintiff’s Amended Complaint is dismissed for failure to state a claim upon which relief can be granted. IT IS FURTHER ORDERED that Counts II through VII of Plaintiff’s Amended Complaint are dismissed for lack of subject matter jurisdiction.
