reasons set forth in the separately filed memorandum opinion, it is hereby ORDERED as
follows:

The motion for summary judgment (Doc. No. 25) is GRANTED;
2.
Judgment is ENTERED in favor of the defendant, the City of Bethlehem; and
3.
The clerk of court shall mark this matter as CLOSED.
