ORDER THAT PLAINTIFFS 18 MOTION IS GRANTED IN PART TO THE EXTENT THAT A COLLECTIVE ACTION IS CONDITIONALLY CERTIFIED WITH RESPECT TO PLAINTIFFS CLAIMS CONCERNING DEFENDANTS FAILURE TO PAY EMPLOYEES FOR ALL HOURS WORKED. THE COLLECTIVE SHALL INCLUDE ALL CURRENT AND FORMER HOURLY SERVICE REPRESENTATIVES (DRIVERS) AND CUSTOMER SERVICE REPRESENTATIVES WHO WORKED FOR DEFENDANTS AT DEFENDANTS HANOVER, HARRISBURG, LANCASTER, WYOMISSING, AND YORK LOCATIONS IN PENNSYLVANIA AT ANY TIME ON OR AFTER MARCH 15, 2014. THE PARTIES SHALL CONFER AND REACH AGREEMENT ON A PROTOCOL FOR THE PRODUCTION OF CONTACT INFORMATION AS WELL AS THE FORM AND CONTENT OF THE NOTICE TO BE SENT TO THE POTENTIAL MEMBERS OF THE COLLECTIVE ACTION, CONSISTENT WITH THE OPINION IS SUED THIS DATE. THE PARTIES SHALL FILE A JOINT MOTION FOR APPROVAL OF COURT-FACILITATED NOTICE WITHIN TWENTY-ONE DAYS OF THE DATE OF THIS ORDER. Plaintiff’s Motion is GRANTED IN PART to the extent that a collective action is conditionally certified with respect to Plaintiff’s claims concerning Defendants’ failure to pay employees for all hours worked. The collective shall include “all current and former hourly Service Representatives (drivers) and Customer Service Representatives who worked for Defendants at Defendants’ Hanover, Harrisburg, Lancaster, Wyomissing, and York locations in Pennsylvania at any time on or after March 15, 2014.” 2. The parties shall confer and reach agreement on a protocol for the production of contact information as well as the form and content of the notice to be sent to the 1 042418 potential members of the collective action, consistent with the Opinion issued this date. The parties shall file a Joint Motion for Approval of Court-Facilitated Notice within twenty-one days of the date of this Order. 3. The deadlines set forth in Paragraph 3 of this Court’s Order of June 2, 2017, ECF No. 33, governing further proceedings following a grant of Plaintiff’s Motion are now in effect.
