Plaintiff’s partial motion for summary judgment as to Count II, only, of the
Amended Complaint, see ECF No. 57, is GRANTED.

Defendant’s motion for summary judgment as to Counts I and II of the Amended
Complaint, see ECF No. 59, is DENIED.
