ORDER - The Report and Recommendation is ADOPTED, IN PART, with respect to the stipulated dismissal of Defts' Whitaker and Wells, and the Clerk of Court is directed to TERMINATE Defts Whitaker and Wells from this action. Defts' objections, (Doc 108), are SUSTAINED to the extent that the Report and Recommendation (Doc 95), did not address Defts' renewed motion to dismiss (Docs 22, 83) and the remainder of the Report and Recommendation is REJECTED on this basis; and the matter is REMANDED to MJ Carlson for consideration of Defts' renewed motion to dismiss, (Docs 22,83).
