ORDER - 1. adopting in part Report and Recommendations re 6 Report and Recommendations. 2. Plaintiffs Objections to Report and Recommendation and his addendum to the Objections Doc 7, 8 are OVERRULED, in part, and SUSTAINED, in part; 3. Plaint iff's claims for monetary damages against Defendants in their official capacities are DISMISSED, with prejudice; 4. Plaintiff's requests for relief in the form of transfer are DISMISSED, with prejudice, from this action; 6. Plaintiff 9;s claims against all Defendants in their official capacities are DISMISSED, with prejudice; 7. The claims against Defendant Bickell, Showalter, Yost, Wlaters, Hicks-Kern, and Granlund, in their personal capacities, will be allowed to proceed; 8. The Plaintiff has thirty (30) days from the date of this Order in which to amend his Complaint in accordance with the accompanying Memorandum; and 9.
