ORDER - Plaintiff's Motion for Leave to Proceed in forma pauperis (Doc. 2) is GRANTED. The January 23, 2014 Report and Recommendation of Magistrate Judge Martin C. Carlson (Doc. 5) is ADOPTED. Plaintiff's claims for damages against the Comm onwealth of Pennsylvania Department of Corrections, and claim seeking criminal prosecution of a third party, are DISMISSED,; and, the action will PROCEED against the individual Defendant.
