ORDER ADOPTING REPORT AND RECOMMENDATION. The Report and Recommendation (Doc. 39), is ADOPTED for reasons stated therein. Because Pltf did not amend his Fourth Amendment claim against Deft Kachinsky in the time allotted by this Court's prior Ord er, (Doc. 38), that claim is now DISMISSED WITH PREJUDICE. The Clerk of Court is directed to TERMINIATE Deft Kachinsky from the action. The case is REMANDED to MJ Saporito for further proceedings consistent with this Order. Signed by Honorable Robert D.
