ORDER granting in part and denying in part 26 Motion for Summary Judgment. The motion is DENIED with respect to the Eighth Amendment excessive force claim against Defendants Kabilko, Reese and Joy. The motion s is GRANTED with respect to Plaintif f's claim that Defendant Kabilko, Reese and Joy violated prison policies. The motion is GRANTED with respect to the Eighth Amendment deliberate indifference claim, and the ADA claim against all Defendants.
