MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that the 28 First MOTION to Dismiss filed by Christopher A Bailes is GRANTED to the extent that this court will schedule a hearing at which the parties will develop an evidentiary record and provide argum ent concerning the factual basis for the Court's subject matter jurisdiction.
