ORDER - IT IS HEREBY ORDERED that Magistrate Judge Schwab's 7 Report and Recommendation is ADOPTED IN ITS ENTIRETY. Defendant's 3 Motion to Dismiss is GRANTED. Plaintiff's Complaint, ECF No. 1, is DISMISSED WITHOUT PREJUDICE. Plaintiff is GRANTED LEAVE to amend her complaint to correct the deficiencies identified by Magistrate Judge Schwab in the Report and Recommendation.
