MEMORANDUM ORDER: AND NOW, this 10th day of May, 2024, IT IS HEREBY ORDERED that Defendants' partial motion to dismiss, ECF No. 42 , is GRANTED and Counts II and II of Plaintiff's second amended complaint are DISMISSED with prejudice. In a ddition, Count IV of Plaintiff's second amended complaint is DISMISSED with prejudice pursuant to 28 U.S.C. §§ 1915(e)(2)(B) and 1915A(b). The report and recommendation of Chief Magistrate Judge Lanzillo, issued April 18, 2024, ECF No. 47 , is adopted as the opinion of the court. Signed by Judge Susan Paradise Baxter on 5/10/2024. (snc)
