MEMORANDUM and CASE MANAGEMENT ORDER NO. 1: As stated more fully in accompanying Memorandum, 491 All Pltfs' Joint MOTION for Multidistrict Case Management Order Number One is granted in part and denied in part, 488 MOTION for Leave to File t o File Joint Consolidated Amended Class Action Complaint is granted in part and denied in part, and 504 MOTION for Leave to File Sur-Reply Brief is denied; Instant case shall be consolidated with Civil Action Nos. 02-1201, 05-688 and 05-1386, until further order, for pretrial purposes; This order does not constitute a determination that these actions are consolidated for trial, nor does it have the effect of making any entity a party to an action in which it has not been joined and served in a ccordance with the Federal Rules of Civil Procedure; Instant case shall serve as the master docket and case file under the caption, styled "In re Community Bank of Northern Virginia Mortgage Lending Practices Litigation"; All orders, pleadi ngs, motions, and other documents will, when filed and docketed, be deemed filed and docketed in each individual case to the extent applicable; Orders, pleadings, motions and other documents will bear a caption similar to that of this Order; If gener ally applicable to all consolidated actions they shall include in their caption a notation that they related to "ALL CASES" and be filed and docketed only in the master file; Documents intended to apply only to a particular case will indica te in their caption the case number of the cases to which they apply, and be filed in both the master file and the individual case file; Pursuant to Fed.R.Civ.P. 23(d) and 23(g)(3), Attorneys R. Bruce Carlson of Carlson Lynch Ltd., and R. Frederick W alters of Walters, Bender, Strohbehn and Vaughan, P.C are appointed interim Co-Lead Counsel and shall perform those duties, specified in Section (3)(b) of the within Case Management Order; All counsel shall keep a daily record of their time spent and expenses incurred in connection with this litigation indicating with specificity the hours, location, and particular activity; Failure to maintain such records will be grounds for denying court-awarded attorneys' fees, as will insufficient desc ription of the activity; Plaintiffs' Joint Amended Consolidated Complaint and RICO Case Statement shall be due by 10/4/2011; Parties shall conduct a Rule 26(f) Meeting on or before 10/11/2011; Any Response to Plaintiffs' Joint Amended Conso lidated Complaint and RICO Case Statement shall be due 10/25/2011; Joint Report of the Parties and Proposed Scheduling and Discovery Order, pursuant to LCvR 23.E due by 10/25/2011; All prior written discovery to which responses have not yet been served are deemed withdrawn; All previously entered confidentiality orders shall remain in effect.
