OPINION AND ORDER OF COURT: denying 8 Motion to Dismiss; granting 8 Motion to Strike. AND now, this 6th day of November, 2009, upon consideration of the Partial Motion to Dismiss 8 Pursuant to Federal Rule of Civil Procedure 12(b)(6) and Motio n to Strike Pursuant to Federal Rule of Civil Procedure 12( f), filed by Defendants, it is hereby ORDERED that Defendants' Partial Motion to Dismiss is DENIED, Defendants Motion to Strike is GRANTED to the extent that references to settlement ne gotiations contained in Paragraph 11 of Plaintiffs Amended Complaint are stricken and Exhibit "C" relating to settlement negotiations is also stricken.
