ORDER granting in part 23 Motion to Dismiss and Count One of Plaintiff's Complaint is dismissed. As a result of the dismissal of Count One, the Court does not continue to have jurisdiction over Plaintiff's state law claims and, thus, same will be REMANDED to the Court of Common Pleas of Allegheny County, Pennsylvania forthwith.
