MEMORANDUM OPINION indicating that, for reasons stated more fully within, the Court grants Defendants' Motion to Dismiss Certain Claims 5 and thus Plaintiff's claims for Defendant's failure to consider his application for the positio n of Duquesne University School of Law ("law school") dean during the 2004-2005 decanal search on the basis of race, any claim based on the Law School decanal search that took place in 2009-2010, claims of hostile work environment and claims for failure to investigate are dismissed, with prejudice. Plaintiff, if he chooses to do so, may file an amended complaint on or before 3/7/11. An appropriate Order follows. Signed by Judge Nora Barry Fischer on 2/15/11. (jg)
