ORDER adopting 37 Report and Recommendation. Plaintiffs' Motion for Summary Judgment (Doc. 25 ) is GRANTED IN PART and DENIED IN PART. Plaintiffs are granted summary judgment on their claim for an imposition of a constructive trust, and an accounting shall be completed to determine the scope of expenditures made in connection to the property and the tax status of the property. The parties shall participate in a settlement conference with Magistrate Judge Mitchell prior to the completion of an accounting. Plaintiffs are denied summary judgment as to all other counts. Defendant is granted summary judgment sua sponte on Counts 1, 3, 4, 5, 6, 7, 8, 9, and 10. Signed by Judge Cathy Bissoon on 8/15/2014. (sje)
