On September 15, 2015, the Magistrate Judge issued a Report (Doc. 9) recommending that the petition for a writ of habeas corpus be dismissed as untimely, and that the certificate of appealability be denied. Service of the Report and Recommendation was made. On September 29, 2015, Mark Shaffer (“Petitioner”) filed his objections. (Doc. 10). After a de novo review of the pleadings and documents in the case, together with the Report and Recommendation and the Objections thereto, the following Order is entered: The Petition of Mark E.
