OPINION granting 29 Motion for Partial Summary Judgment. Upon consideration of the foregoing, the claim for Bad Faith asserted by Dr. Stewart, in each instance and in the totality of circumstances, fails to produce sufficient evidence for any jury to conclude bad faith by clear and convincing evidence. As such, GEICOs Motion for Partial Summary Judgment is granted. Dr. Stewarts claim for Bad Faith in Count II of his complaint is dismissed. A separate order will follow. Signed by Judge Marilyn J.
