Simpson, through his counsel, Assistant Federal Public Defender Markéta Sims, respectfully files the within Response to Tentative Findings. In its Tentative Findings, the Court tentatively found the applicable statutory mandatory minimum is five years. Tentative Findings, ¶ 6. However, the Court also found that Mr. Simpson has met the criteria for the "safety valve," 18 U.S.C. § 3553(f). Tentative Findings, ¶ 2.
