ORDER RULING ON REPORT AND RECOMMENDATIONS. It is therefore ORDERED that Tippett shall have ten (10) days from the date of this order to withdraw or amend his petition. It is further ORDERED that if Tippett does not withdraw his petition within ten (10) days, the court will recharacterize his filing as a § 2254 petition and proceed to the merits of his claim.
