Defendants. ) ) ) ) ) ) ) ) ) ) Civil Action No. 2:09-2119-MBS CONSENT AMENDED SCHEDULING ORDER Pursuant to the Federal Rules of Civil Procedure and the Local Civil Rules of the United States District Court for the District of South Carolina, Charleston Division, the Parties jointly propose the following Consent Amended Scheduling Order for the above-captioned case. 1. Rule 26(f) Conference: A conference of the parties pursuant to Fed. R. Civ. P. 26(f) was held on October 5, 2009. 2. Rule 26(a)(1) Initial Disclosures: The parties shall file their Fed. R. Civ. P. 26(a)(1) initial disclosures no later than October 19, 2009. 3. Rule 26(f) Report: The parties shall file a Fed. R. Civ. P. 26(f) Report no later than October 19, 2009. 4. Amendment of Pleadings: Motions to join other parties and amend the pleadings shall be filed no later than December 14, 2009. 5. Expert Witnesses: Parties shall file and serve a document identifying by full name, address, and telephone number each person whom they expect to call as an expert at trial by the following dates: Plaintiff: January 14, 2010 Defendant: February 12, 2010 Dockets.Justia.com 6. Records Custodian Witnesses: Counsel shall file and serve no later than April 15, 2010 affidavits of records custodian witnesses proposed to be presented by affidavit at trial. Objections to such affidavits must be made within 14 days after service of the disclosure. 7. Discovery: Discovery shall be completed no later than April 15, 2010. All discovery requests shall be served in time for the responses thereto to be served by this deadline. 8. Dispositive Motions: All dispositive motions shall be filed on or before April 30, 2010. 9. Mediation: Mediation, pursuant to Local Civil Rules 16.04 - 16.12, shall be completed in this case on or before June 28, 2010. The parties shall file ADR Statements on or before May 28, 2010. 10. Rule 26(a)(3) Pretrial Disclosures: The parties shall file and exchange Fed. R. Civ. P. 26(a)(3) pretrial disclosures no later than July 12, 2010, with objections by July 26, 2010. 11. Motions in Limine: Motions in Limine shall be filed on or before July 23, 2010. 12. Marking & Exchanging Exhibits: The parties shall meet to mark and exchange exhibits no later than August 2, 2010. Pretrial Briefs: Parties shall provide the Court with pretrial briefs no later than August 9, 2010. 1. Trial: This case will be tried during the term of court beginning August 16, 2010. s/Margaret B.
