Motion for Extension of Time for Expert Witness Disclosures

Pursuant to Local Civil Rule 6.01, the Plaintiff, Roger Cleveland Golf Company, Inc., moves for an extension of the current deadlines of January 14, 2010 and February 12, 2010 for plaintiff's and defendants' expert witness disclosures, respectively. Plaintiff requests that these deadlines be extended to March 1, 2010 and April 1, 2010, so as to allow additional time for the parties to resolve this matter without incurring expert fees and costs which might prove a hurdle to settlement. Neither this deadline nor any other deadline has previously been requested to be extended since the Court's entry of the Consent Amended Scheduling Order which was submitted with the parties' Joint 26(f) Report, and the extension requested will not affect other deadlines. An amended scheduling order reflecting these changes will be submitted to this Court for consideration, and Plaintiff would respectfully request its entry. Prior to filing this motion, counsel for Plaintiff contacted opposing counsel a number of times to obtain his consent to this Motion, but received no response.
