Defendants. ) ) ) ) ) ) ) ) ) ) Civil Action No. 2:09-2119-MBS THIRD AMENDED SCHEDULING ORDER Pursuant to the Federal Rules of Civil Procedure and the Local Civil Rules of the United States District Court for the District of South Carolina, Charleston Division, the Parties jointly propose the following Third Amended Scheduling Order for the above-captioned case. 1. Service of First Amended Complaint: Plaintiff shall file and serve the First Amended Complaint within thirty (30) days of the date of the Court's order granting Plaintiff leave to amend. 2. Rule 26(f) Conference: A conference of the parties pursuant to Fed. R. Civ. P. 26(f) shall be held within thirty (30) days of the service on any new party in the event a new party makes an appearance in this case. 3. Rule 26(a)(1) Initial Disclosures: The parties shall file their Fed. R. Civ. P. 26(a)(1) initial disclosures within one (1) week of the Rule 26(f) conference. 4. Rule 26(f) Report: The parties shall file a Fed. R. Civ. P. 26(f) Report no later than one (1) week of the Rule 26(f) conference. 5. Amendment of Pleadings: Motions to join other parties and amend the pleadings shall be filed no later than June 14, 2010. 6. Expert Witnesses: Parties shall file and serve a document identifying by full name, address, and telephone number each person whom they expect to call as an expert at trial by the following dates: Plaintiff: July 14, 2010 Defendant: August 12, 2010 7. Records Custodian Witnesses: Counsel shall file and serve no later than September 15, 2010 affidavits of records custodian witnesses proposed to be presented by affidavit at trial. Objections to such affidavits must be made within 14 days after service of the disclosure. 8. Discovery: Discovery shall be completed no later than September 15, 2010. All discovery requests shall be served in time for the responses thereto to be served by this deadline. 9. Dispositive Motions: All dispositive motions shall be filed on or before September 30, 2010. 10. Mediation: Mediation, pursuant to Local Civil Rules 16.04 - 16.12, shall be completed in this case on or before August 30, 2010. The parties shall file ADR Statements on or before July 30, 2010. 11. Rule 26(a)(3) Pretrial Disclosures: The parties shall file and exchange Fed. R. Civ. P. 26(a)(3) pretrial disclosures no later than December 1, 2010, with objections by December 15, 2010. 11. Motions in Limine: Motions in Limine shall be filed on or before December 6, 2010. 12. Marking & Exchanging Exhibits: The parties shall meet to mark and exchange exhibits no later than December 17, 2010. Pretrial Briefs: Parties shall provide the Court with pretrial briefs no later than December 24, 2010. 1.
