OPINION AND ORDER adopting 30 Report and Recommendation of Magistrate Judge Mary Gordon Baker; granting in part and denying in part 22 Motion to Dismiss for Failure to State a Claim. Defendant's motion to dismiss P laintiff's claims for denial of medical leave and outdoor recreation is DENIED, and those claims survive the motion to dismiss. Defendant's motion to dismiss Plaintiff's claims for freedom of religion and access to the grievance system is GRANTED, and those claims are DISMISSED.
