ORDER SUBSTITUTING PARTY
This matter comes before the court on the motion of defendants to substitute Mr.
Rokey Suleman for Samuel J. Selph. [ECF No. 27]. Defendants represent that Mr. Selph
is no longer associated with the Richland County Elections & Voter Registration
Commission and that Mr. Suleman is the current Director of that Commission. Pursuant
to Fed. R. Civ. P. 25(d), “an action does not abate when a public officer who is a party in
an official capacity . . . otherwise ceases to hold office while an action is pending.”
Moreover, that officer’s successor “is automatically substituted as a party.” Id. The court
grants the motion to substitute [ECF No. 27] and directs the Clerk’s Office to change the
docket, as in the above caption, to reflect the substitution.
IT IS SO ORDERED.
