ORDER RULING ON REPORT AND RECOMMENDATIONS. The Court adopts the R&R as the Order of the Court and it is hereby ORDERED that the Plaintiff's Complaint is dismissed pursuant to Rule 41(b) of the Federal Rules of Civil Procedure. Therefore, the Defendants' motion to dismiss (Entry 36) is granted, and the Defendant's Motion for summary judgment (Entry 30) is deemed moot. Signed by Honorable Sol Blatt, Jr on 04/13/2010.
