Campbell v. Hartford Life and Accident Insurance Company
Filing 32
OPINION AND ORDER: Plaintiff's claim for benefits under 29 U.S.C. § 1132(a)(1)(B) is dismissed because the Plan Administrator's decision to deny Plaintiff's claim for long term disability benefits on and af ter September 17, 2009, was the result of a deliberate, principled reasoning process and supported by substantial evidence. Hartford did not abuse its discretion. Plaintiff's request for attorney's fees and costs is denied. Specifically, Plaintiff's 29 motion for judgment is DENIED. Defendant's 28 motion for judgment is GRANTED. This case is hereby DISMISSED with prejudice. Signed by Honorable R Bryan Harwell on 2/1/2011. (prou, )
