ORDER RULING ON REPORT AND RECOMMENDATIONS. The Court adopts the Report and Recommendation 49 as the order of this Court. For the reasons articulated by the Magistrate Judge, it is hereby ORDERED that Defendants' motion for summary judgment 40 be GRANTED IN PART as to all of Plaintiffs claims against the Spartanburg County Sheriffs Department and his claim for the return of his personal property and DENIED IN PART as to Plaintiffs claim against Deputy Jeff Strickland for excessive force.
