ORDER ADOPTING 60 REPORT AND RECOMMENDATION re 43 Motion for Summary Judgment, filed by Neil Frebowitz, Chief Rhodes. The Court grants summary judgment to Defendant Rhodes and denies it without prejudice as to Defenda nt Frebowitz. This matter is stayed pending resolution of Plaintiff's criminal charges in state court. Plaintiff is orders to apprise the Court of the status of those criminal charges every six months, and to notify the Court within thirty (30) days when those criminal charges are resolved.
