ORDER RULING ON REPORT AND RECOMMENDATION: The Court agrees with and adopts the R&R as the order of the Court (Dkt. No. 17 ). Accordingly, this action is dismissed with prejudice pursuant to 28 U.S.C. § and this dismissal is deemed a "strike" under 28 U.S.C. § 1915(g).
