ORDER RULING ON REPORT AND RECOMMENDATION: the Court agrees with and adopts the R&R 11 as the order of the Court. Accordingly, Plaintiff's motion for leave to proceed in forma pauperis is denied (Dkt. No. 2 ). Further, Plaintiff shall have until fifteen days from the date of the entry of this order to pay the Court's filing fee. If Plaintiff fails to pay the fee within this fifteen-day period, the Clerk shall dismiss this action without prejudice and without issuance and service of process.
