Pursuant to the Court’s Notice of Intent to Appoint Special Master, the parties jointly
report to the Court as follows:
1. They have conferred over the contents of the appointment order;
2. They agree on the contents of the proposed appointment order, with the following
exceptions:
A. The parties prefer that the current mediator, Thomas Wills, continue to facilitate
settlement communications between the parties; and

B. The parties prefer that the plaintiffs’ motion for class certification, including
plaintiffs’ motion for certification of any settlement classes, and related issues be
retained and determined by the District Court.
