ORDER granting 3 motion to proceed in forma pauperis and dismissing case. Plaintiff shall pay an initial partial filing fee of $12.61, and shall be required to pay the applicable $350 filing fee in its entirety. The institution having cu stody of the plaintiff shall forward to the US District Court Clerk's Office 20 percent of the funds in the plaintiff's trust account when it exceeds $10 until the filing fee is paid in full.
