MEMORANDUM AND ORDER; plaintiff's application to proceed in forma pauperis 1 is GRANTED. However, no service shall issue and his complaint will be dismissed. For the reasons set forth above, the Court finds that plaintiff has failed to state a claim for relief under 1983 and that his case should be dismissed sua sponte. A separate order will enter.
