MEMORANDUM AND ORDER, plaintiff's application to proceed in forma pauperis 1 is GRANTED. This complaint will be dismissed sua sponte for plaintiff's failure to state a claim. And likewise based on the above discussion, t he Court FINDS that any appeal taken in this matter would not be taken in good faith, therefore, should plaintiff file a notice of appeal, he is DENIED leave to proceed on appeal in forma pauperis.
